What is the legal basis?
The Eco Labelling Act (Ă–koKennzG) of December 10th, 2001, is the legal basis for the Bio-Siegel. Among other things, this Act stipulates the penalty and fine regulations in case of misuse of the Bio-Siegel. With regard to the criteria for the Bio-Siegel use the Eco Labelling Act refers to the requirements of the EU Organic Farming Regulation (Regulation [EEC] No 2092/91 and subsequent regulations). All agricultural produce labelled with the Bio-Siegel must be produced and inspected in compliance with this regulation. Details regarding the design and the use of the Bio-Siegel are specified in the Eco Labelling Regulation of February 16th, 2002. This regulation stipulates a notification obligation before the Bio-Siegel is used for the first time.
